This part is legal for sale and use on Emissions Controlled Vehicles, in all 50 states, when used in accordance with the manufacturers application guide because it has a California Air Resources Board (CARB) Executive Order (EO) number.
The following vehicles are considered Emissions Controlled Vehicles:

Instructions for Part# D440-1640-ST1
This kit is ONLY for cars equipped with BMW M-Performance software (MPPK). The vehicle also needs to be equipped with an mechanical wastegate. Any 335i with a production date before 07/2013 should have a mechanical wastegate. Only a visual identification is 100% accurate however. Please consult the wastegate identification guide in the installation instructions to accurately identify what is on the vehicle.
